Terms of Service

1. What eFountain is — and what you buy

eFountain (efountain.net) is a digital entertainment service: a virtual wishing fountain. You purchase virtual coins, toss them into the fountain and make wishes.

Buying coins is the purchase of a digital service. It is not a donation to charity, it does not create any donor relationship between you and any charity, and it does not entitle you to a tax receipt of any kind. Displayed prices include any applicable taxes.

The company operating eFountain may, from time to time and entirely at its own discretion, choose to support causes of its choosing. Any such support is voluntary and one-off: it is not a promise, a percentage, or an ongoing commitment of any kind, and it creates no right or expectation for you.

2. Coins and packs

A coin costs €0.50, any applicable taxes included. Coins are sold only in fixed packs of 6, 10, 20 and 40 coins, and there are no volume discounts. Prices are set per currency as round amounts — never converted at the daily exchange rate — and the currency is locked at the moment of purchase.

Coins are non-refundable. By purchasing coins you expressly consent to the immediate supply of digital content and acknowledge that you thereby lose your statutory right of withdrawal (Article L.221-28 of the French Consumer Code).

Coins expire ten (10) years after their purchase date, for as long as the company operates the service. Coins have no monetary value, cannot be exchanged for cash, and cannot be transferred outside the features the service provides.

The per-coin and pack prices in each supported currency are:

  • EUR, USD, GBP, CHF, CAD, AUD, NZD and SGD: 0.50 per coin — packs of 3.00, 5.00, 10.00 and 20.00.
  • JPY: ¥100 per coin — packs of ¥600, ¥1000, ¥2000 and ¥4000.
  • KRW: ₩1000 per coin — packs of ₩6000, ₩10000, ₩20000 and ₩40000.

3. Your wishes

A wish is never published when it is made. A kept wish is stored so that you may share it later; it is displayed nowhere on the service unless you explicitly ask us to publish it.

A sealed wish is encrypted in your browser before transmission, using a key derived from your password. We store only the encrypted text and cannot read it. If you reset your password, your sealed wishes become permanently unreadable — this is warned about explicitly before any reset, and you accept this consequence when using sealed wishes.

Publication is possible only for a wish you have marked as come true, and only for what you explicitly choose to share (the wish, the note about what happened, or both). What you choose to share is reviewed before publication (see section 5) and, once published, is displayed anonymously in the Guestbook.

You keep ownership of the text of your wishes. By choosing to share a wish or a note you grant us a non-exclusive, worldwide licence to display it on the service, anonymously, for as long as it remains published.

4. Acceptable use

Anything you choose to publish in the Guestbook is visible to everyone, including children. The following are prohibited in any content submitted for publication (wishes and realization notes):

  • hate speech, harassment, threats or incitement to violence;
  • sexual or otherwise adult content;
  • personal data about yourself or anyone else (names, addresses, phone numbers, emails);
  • advertising, spam, links or promotional content;
  • content that is illegal under French or EU law;
  • attempts to disrupt, overload or abuse the service, including automated access.

5. Moderation

Every wish and realization note submitted for publication is reviewed before it appears, through a combination of automated filtering, AI review and human moderation. Nothing is reviewed before you ask for publication — as long as you keep a wish to yourself, no one reads it.

Content that does not meet these terms is hidden, not deleted: it stops being visible on the service but is retained internally for audit and legal purposes.

We may suspend or close accounts that repeatedly or seriously breach section 4. Coins are not refunded in case of closure for abuse.

6. Age

You must be at least 16 years old to create an account and use eFountain.

7. Pilot phase

The service is currently in a pilot phase during which payments are simulated: no real money is charged and coins credited during this phase carry no monetary value whatsoever. These terms apply in full when real payments are enabled, and this section will be removed at that point.

8. Availability and liability

The service is provided "as is". We work to keep the fountain flowing but do not guarantee uninterrupted availability, and we may modify or discontinue features.

Making a wish is an act of hope, not a contract: eFountain makes no promise, of any kind, that wishes come true.

To the extent permitted by law, our liability for any claim related to the service is limited to the amount you paid for coins in the twelve months preceding the claim.

9. Changes to these terms

We may update these terms. Material changes will be announced on the service at least 30 days before they take effect. Continuing to use the service after that date means you accept the new terms.

10. Governing law and contact

These terms are governed by French law. Any dispute that cannot be resolved amicably falls under the jurisdiction of the competent French courts, without prejudice to mandatory consumer protection rules of your country of residence.
